On November 27, 2009, the USCIS announced that 58,900 of 65,000 regular cap petitions have been received. In addition, approximately 20,000 U.S. Master's or higher petitions (i.e. advanced degree petitions) have been received. Any advanced degree petitions received from here on out will count toward the regular cap of 65,000. The USCIS is still accepting petitions at this time, but it is advised that any H-1B petitions be filed as soon as possible as the USCIS could announce that the cap is closed at any time.

Do u know if its possible to schedule an earlier fingerprinting date? can we just walk to a ASC with our appointment letter and get our fingerprinting done?

When you use EAD it does not matter if the company got any money under the TARP program or not.
You should not even bring this to the attention to your HR. Go and use EAD as if the company is just any other company, make sure that the job is "same / similar" and get a lawyer for using AC21 portability.

I have a question; my girlfriend came to the US with a tourist visa in 2002 (now her visa is expired), so now I guess she is an ilegal alien, my question is: Is there anyway she can become a legal resident?

My employer is a single architect and owner of his sole proprietorship LLC firm and he filed an EB3 I-140 for me submitting the "Schedule-C" of his tax return, which shows a net profit of $57000 for the company. The prevailing wage for my architectural technician position is $35,100, and NSC is asking for my employer's personal financial documents, saying that they are not satisfied only with "Schedule-C" and �Net Profit� of his tax return and a sole-proprietor petitioner has to prove that he can sustain his household and the proffered wage. Can USCIS ask for personal finances when the net profit of the company is clearly greater than the prevailing wage? Has anyone been in the same situation? Any suggestions from the gurus?

My I-94 and L1A visa expired on October of 2008. I received my I-797A notice of action and my extended I-94, which is valid until June of 2010. My HR manager said I should be ok as long as I don't leave the USA.
I need to travel outside of the United States for one week. Will I be able to re-enter the USA if I show the approved Petition I-129 with the new I-94 and the expired visa?
Or will I need to go to the consulate to get a new visa stamp extended to June 2010 to re-enter the USA?
I will appreciate your help.

Hello,
I am working in New Jersey(8th yr H1B extension) and my Employer is in Illinois. In my H1B LCA he mentioned Prevailing wage for New Jersey and Illinois.
1.My Employer is deducting tax from Illinois instead of New Jersey in
my Pay Slip. Can you please tell me which Prevailing wage I need to
compare in this situation?
2.Do I need to compare Gross pay of every month with the amount
mentioned in LCA or total amount (including all Bonus amount).
Please advise me .

Canada gives 50% credit for stay in canada using legal visa, prior to obtaining PR towards citizenship.

My I-485 has been pending for more than 6 months now. I have an EAD but I got an RFE on my AP. I don't know what its about as I have not received the RFE yet.
I am thinking of changing my job. In my new job I don't want to use my EAD since my AP status is still hanging. Can I keep working on H1-B visa as I still have 3.5 years left on my H1? If I travel outside the country, can I re-enter with a valid H-1B visa? Can this cause an abandonment of AOS if I enter on H-1B while my AOS is pending? Please let me know. Thank you.
