    I am on EB-2. Priority date Apr 2005. Sent 485 application last week.

    Hi,

    My employer filed H1B transfer in Feb 2009. however he could not receive RFE letter with in time on mail and only received after RFE submitted date was expired which is May 25th, 2009

    In jun1 1st week , he filed for the RFE extension for the stated reason and also refiled H1B to make sure that I should be in valid H1B status in case of first H1B denial in mean time

    Employer submitted all the documents related to RFE on June 20th and it got approved on jul 1st.

    What are the best options for H1B refiling case

    in case if it is denied, will it super impose the original H1B approval ?

    is it good idea to cancel/revoke pending H1B refiling case ?

    I applied an LC from an employer on March 27th 2005 (Pre-PERM)
    It is shifted to P-BEC. I have not got any 45 day letter for that
    How do I get the 45 day letter?

    The D40 requires an AF-S lens as far as I know, I have never actually used one. I know it will work wit the D70. I recommend trying it out before buying it if that is possible. It works on the D70 by setting everything to manual. Good luck

    Hi,
    I am curently on h1b visa on 7th year.My i-140 got approved 3years back and filed i-485 in 2007 and waiting for gc.Now if i switch my job to different employer using my EAD,Can my previous employer revoke my i-140 affecting my gc processing.Does he still have control to withdraw.Can you please help on this.Thanks.
    Employer can withdraw anytime. But you should be OK with AC21 provisions.

    It doesn't look like a sunset initially. At first I thought it was a picture of fire with the outline of a dragon in the bottom left in orange haha. The text could be a bit more legible though. The malaysia text looks a bit blurred in areas.

    Does the husband has a pending LC / I140 / I485? If yes, the dates matters.
    What was the reason for denial of his H1?

    My friend is on H1 and her husband's H1 extension denied after 6 th year.Can she add her husband to her H1?
    Can a person stay in USA on H category continuosly more than 6 year??

    I have appeared for interviews in toronto. They have not looked at my pay stubs in detail. The most they would go is to check if you are still employed with the same firm. Again, this said each case is different. Stuff like Employer reputation, qualification etc., surely helps.

    Switched jobs in April 07. My attorney tells me that my Labor can be filed only in mid July at the earliest.

    1. How long does it take for Labor to be approved? I am guessing end of September is when retrogression will kick in. Do I have enough time for that?
    2. How long does it take to get the documents ready for to file I-140 and I-485 (counting eggs before it's hatched)? If I have Birth and Marriage certificates ready, is there anything else that I should watch out for?

    BTW, don't think I am trying to take a short cut to independence. I did my time in backlog for 3 years, got fed up and quit.

    Hi All ,

    I am currently on L1B visa valid till Dec 25 2008 and current I-94 valid still July 2009.

    I can't apply for I-94 extension until Jan 09.
    I am travelling to india on Nov and will return on Nov 30 2008.

    Is it advisable to go for Visa Stamping during Nov 08 or can i file my extension once i returned back to US on NOv 30 2008.My visa will be valid only for 25 days and want to know if that will create any issues.

    Any views would be greatly appreciated.
