    Hi

    I need to travel out of US urgently because of family emergency.

    1) Can I get emergency AP from local/district ofices with supporting documents

    2) I saw that I can travel until I get my AP approved.Has any oine denied entry because of they travelled out of US while ap processing is pending.Any experiences..

    I got an H1 from an employer with changes of status from L1 effective 31- jan but I will be joining this company only on 4-april-2011. I continued to work for L1 employer till
    20-Feb after which i returned to India.
    Now i have my visa interview - will i face issues because of the 25 days i spend with L1 employer and that I dont have H1 employer pay stubs?

The U.S. is obsessed with importing poverty from poor non-assimilated immigrants (mostly illegal) and shunning high-skilled immigrants who assimilate and increase the country's living standards.     Hello Gurus,

    Pl guide me and let me know my options for the below scenario...

    1. Me: Applied under EB2 (India) and have I-140 approved in September 2006.
    Status as of now : Applied as dependent (secondary) on my spouse 485 and have EAD and AP since July 2007.

    2. My spouse : Primary applicant - EB3 (India), December 2003.


    As the dates are NOT moving forward for EB3 (India), I want to port our GC application dates from my spouse priority ( EB3- India - December 2003) to mine (EB2 - India - September 2006)

    My question is, Can I change my status from dependent (secondary ) on my spouse 485 to me being primary applicant by invoking my approved I-140 (EB2 - India - September 2006), If YES what would be the process.

    Tensions are set to rise between the two parties in the Senate in coming weeks, threatening to stifle the Democratic legislative agenda and test the amicable relationship between Majority Leader Harry Reid (D-Nev.) and Republican leader Mitch McConnell (Ky.).

    After the collapse of immigration legislation last week over procedural concerns, rhetoric has been heating up. Democrats increasingly blame McConnell, who is up for reelection in 2008, tagging him as an obstructionist. The GOP stuck that same label on then Minority Leader Tom Daschle (D-S.D.), helping defeat him in his reelection bid in 2004.

    Some conservatives, upset that the immigration bill came to the floor without committee deliberations, grumble that McConnell is not combative enough with Reid and should challenge anything that does not follow regular Senate order, aides to two conservative senators say.

    That could unhinge the cordial relationship between Reid and McConnell, which both say remains strong despite burgeoning battles.

    �This has not been an easy six months,� said Sen. Debbie Stabenow (D-Mich.). �I think our friends on the other side of the aisle have wished to slow things down as much as possible with over and over again motions just to even go to a bill.�

    Republicans accuse Reid of employing procedural tactics in an unprecedented way to bring legislation to the floor without committee debate, to limit amendments on the floor and to end debate on legislation.

    �I don�t know if he understands the difference being a leader and being a dictator,� conservative Sen. Jim DeMint (R-S.C.) said.

    Next week, Reid wants to bring to the Senate floor a bill passed by the House that would make it easier for labor unions to organize workforces, aides say. The bill, long-sought by labor but opposed by business, has not gone through the Senate committee process. Republicans plan to object to the bill�s consideration, forcing Reid to find 60 votes if the measure is to be considered in the narrowly divided Senate.

    Even if the Senate reaches that threshold, Republicans may object to a unanimous consent request to waive 30 hours of debate to proceed to the bill. Doing so would mean debate on the bill would dominate much of the week, which Reid, with scarce floor time and a packed agenda before the July 4 recess, wants to avoid.

    Jostling over process reflects the parties� hope of framing political debate in the run-up to the 2008 elections, analysts say.

    �I think Reid is ultimately � looking ahead to �08, to shape the party�s reputation as much as his own reputation,� said Sarah Binder, senior fellow in governance studies at the Brookings Institution. �How well the Democrats do in part is going to do depend on what Democrats do in Congress, and he can blame Republicans [for] creating stalemates.�

    Republicans point out that Reid has filed 39 cloture motions to limit debate or proceed to legislation this Congress, which is on pace to shatter the 68 cloture motions filed in the entire 109th Congress.

    �[B]The actions of the majority leader in filing cloture so many times this year takes the Senate out of its traditional role and it brings it more towards a House model, where debate is constricted,� said Brian Darling, director of Senate relations for the Heritage Foundation.

    Two efforts to shut down debate on immigration failed last week after Republicans objected that too few of their amendments were considered during the Senate debate. Republicans complained that the Senate could have moved quickly and finished the immigration debate if Reid had tabled amendments or allowed many of them to be considered simultaneously. Reid retorted that Republicans were objecting to their own amendments and would not agree to a set number of amendments that could be considered.

    When the immigration bill fell apart last week, McConnell said, �The message to the majority is, it�s going to take longer than you�d like to take, and it�s going to take more votes than you�d like to make. I think they have had to relearn that lesson several times. That is the reason this Congress, at least to this point, has such a paltry list of accomplishments.�

    Reid shot back this week, saying his frequent use of cloture has been made necessary because of Republican obstruction.

    McConnell �failed to mention that we have to do that because we�re not able to do anything without cloture,� Reid said. �On the most basic bills we did � lobbying ethics reform, minimum wage, 9/11 � everything that we�ve had to do, we have to get 60 votes first. So they�ve made it very difficult for us.�

    To answer you briefly, GC is not something that your company or you can handle by yourself. You definitely need an attorney. There are 3 stages and so many things involved in each stage:eek:. If you get hold of good attorney firm they will have all the templates and will guide you.

    I entered the US as H1-B but moved to EAD status last month.
    My wife entered the US on advance parole and is currently working on EAD.

    Hello Everyone,
    If primary applicant of I-485 uses AC21 and Spouse of primary applicant not planning to work for at least 3 years because of infant kids. Could we please share what are advantages and disadvantages you can think of for not applying an EAD for secondary applicant until ready to find a job?

    Following are list I can think of.
    Disadvantages
    - Secondary will not get SSN and tax rebate
    - Would have to renew for 3 years even though not going to use

    Advantages
    -If get lucky get a Green card without using EAD ever

    I have heard issues with Driving license but that's with having EAD.

    Will try to shorten the story.

    I was with ABC consulting company and had applied for GC (and got perm and 140 approved). My contract with client ended. Though ABC were good but they could not get me a project so I had to shift to another company. I talked to ABC to get my GC proceeding with extra cost. They said (and attorney also) said my 485 has been filed. As the ABC had changed their name also, as notification for I-140. They also insisted to join back.

    My new company layoff quite a lot of people. Needless to say, me also. Now my easy option is to join them back, but is there any possibility that to make me continue to work for them, they can do mess up in GC process?

    May be question is quite personal, please suggest whatever cmes to your mind.

    Against the prevailing dismay over partisanship and dysfunction in the U.S. Senate, consider the testimony of one happy senator.

    Ben Cardin, freshman Democrat of Maryland, says he has been surprised since his election almost a year ago at how possible it is to make progress in the Senate. It is easier to form bipartisan alliances than it was in the House, he says. Senators who strike deals stick to them and will not be pulled away by pressure from party leaders. And, even despite the 60-vote barrier, real legislative accomplishments are within reach.

    Cardin is part of an impressive Senate class of nine Democratic rookies (including Bernie Sanders, an independent who caucuses with the Democrats), others of whom have gotten more attention than he has during their first year. Virginia's Jim Webb, to name one, has proved more compelling to the national party and media, with his military past, literary achievements and quotable economic populism.

    Consider, by contrast, the first sentence of the " About Ben" biography on Cardin's official Web site: "Benjamin L. Cardin has been a national leader on health care, retirement security and fiscal issues since coming to Congress in 1987." No wonder the Democrats chose Webb to respond to President Bush's State of the Union address in January.

    No one would accuse Cardin of putting charisma over substance. A legislator's legislator, he served in the Maryland House of Delegates for 20 years, as speaker from 1979 to 1986, and then represented a part of Baltimore and surrounding suburbs in the House of Representatives for 20 more. Now he's delightedly burrowing into the Senate.

    During a visit to The Post last week, he ticked off a series of what he called medium-level issues on which he believes something can be achieved: providing incentives for good teachers to work in the neediest schools, getting the Army Corps of Engineers involved in Chesapeake Bay cleanup, establishing a commission to chart a path to energy independence within 10 years and reauthorizing (for the first time in decades) the federal program that provides lawyers for those who can't afford them.

    Cardin acknowledged that prospects for progress on the biggest issues are dimmer, but even there he's not discouraged. "Social Security is easy to solve," he says, and achieving energy independence within 10 years is quite doable; both just require more leadership from the White House, which he hopes a new (Democratic) president will provide. He's signed on to the Lieberman-Warner bill on climate change and thinks it could get 60 votes, too, with a little prodding from on high.

    The failure of comprehensive immigration reform, he grants, was "an embarrassment." Senators were not prepared for the force and single-mindedness of the opposition to what was perceived as amnesty for illegal immigrants.

    "It is an explosive issue," Cardin said. "It crippled our office's ability to get anything else done." The letters he received were well written, not part of an organized campaign, from all corners of the state -- and unequivocal. "They said, 'This is not America. America is the rule of law. How can you let people sneak into the country? If you vote for this, I'll never vote for you again' " -- an argument that tends to seize a politician's attention.

    Cardin did not and still does not believe that the bill provided amnesty. It insisted that illegal immigrants atone in a number of ways, including anteing up back taxes, learning English and paying a fine. "If you go much further, people aren't going to come forward" and out of the shadows, he says. "I don't think it makes a lot of sense to be sending troops after them."

    But even here, he has faith that the Senate eventually can pass immigration reform. It was a mistake to craft the bill in closed meetings, he said; next time, open debate would create less anxiety. Reform advocates have to communicate better what requirements they're imposing in exchange for legalization. But ultimately, "you can't hide from what needs to be done. You have to deal with the 12 million, with border security and with the fairness issue" for immigrants and would-be immigrants who have played by the rules.

    Cardin is not naive about the political obstacles to progress. But unusually for Washington, he seems less focused on blaming the other side for gridlock than on avoiding gridlock in the first place.

    "Quite frankly, the solution on immigration is easy, even if it won't be easy to accomplish," he says cheerfully. "You just have to get a bipartisan coalition and get it done."
