Good MOrning All I have 2 questions:
1.) My littel sister is living with a Looser for the past 10 teays and he refuse to file for her Residency. So got pregnat last year and now has a baby by him. Is there anything she can do to get her residency in this situation?
2.) I am married to a US citizen. I have a Pending case with USCIS however it has been draging out for too long. I wanted to file for my Residency using my Current marriage. She is a US citizen however dose anyone know if there is a limit or time frame when a US citizen can file for someone else? She was married before and filed for her X-husband residency. Can she file me now without any problem?

I need some clarity on this issue. I know AC21 helps switching jobs within the same field/duties, but here is my line of thought... I'm past 2yrs on my H1 and I plan to do a part-time MBA (~3yrs) after which I'd like to be open on the kind of job I do.
Now, my questions are: (1) Does switching to EAD really pause the H1 clock?
(2) Is that triggered by filling a new I-9 form alone, or by entering the US on AP, or both?
(3) I guess, I should be able to apply for a fresh H1 with a new company and switch back from the EAD to new H1, right?
I know I'll lose the GC priority, especially wife's EAD, but I'm debating if it's worth losing my career aspirations? My info: Nov '06 EB2 PD, approved I-140, July 3 I-485 receipt and my present company will file our EAD/APs as long as it is necessary.

I have applied for GC in Aug '07. I recently renewed my H1-B (7th year). I noticed that there is a mistake in the A# of my Green card application (Beneficiary #) on the H1-B approval notice.
Has any one else had this happen? Does any one know what can be done regarding this?

you will have to get it corrected, ask you lawyer to file the correction form ( i don't remember the form# top of my head).

Hello everyone,
I'm new to this forum, but this is a great source of information.
Here is my situation. My wife is a US citizen and we've been married for 2 year and 3 months, and I have the conditional green card for almost 2 years. I can't say this has been the best time of my life. She has kids of her own, and we ran into so much problem. And we both wish get a divorce. My conditional green card is expiring, and I know a divorce would affect my status. But seems like I can't take this anymore. During this time, I've been with another us citizen. She understand my situation, and has always supported me. I do want to marry her after my divorce. So, I'm seeking for some advice from everybody on what I should do in this situation. Thank you

Just Ask her to redo the I-9 Employment Verification form and submit to the Employer. Nothing else needed.
My friend H1B is expiring this month end but she has valid EAD wth her.When we are planning to use EAD from H1B,what is the procedure for that?Do we have to send any forms to INS for this change of status??

You can file I-485 only when your PD is current. There is no connection between filing for I-485 and I-140 approval.

I filed for I751 (remove condition of my green card) on June 2007. Received by USCIS on June 07, 2007. I already received my extension and the biometric appointment.... still on Texas center. How long you think I have to wait until I get a response of approval??? they said (before they got behind) that it takes 6 months.... December will be 6 month.... who knows what is really happening on immigration??? what cases they are putting behind and what cases they are working on??? (I know that the time schedule says April 07, but in the last month they only process cases receive on 4 days, last month said April 3 and this month April 7)
The thing is that I want to change my Job, but who will ever hire me with only a 1 year extension green card!!! help please!

USCIS has once again updated its announcement regarding the number of H-1B petitions received and counted towards the H-1B cap. As of May 4, USCIS has received approximately 45,000 H-1B petitions counting toward the Congressionally-mandated 65,000 cap. As such, USCIS continues to accept petitions subject to the general cap. The analysis of census data from both the U.S. and Mexican governments, being released Wednesday by the Pew Hispanic Center, highlights the impact of the economic downturn on Mexican immigrants, many of whom enter the United States illegally. The study found that immigrants arriving from Mexico fell by 249,000 from March 2008 to March 2009, down nearly 60 percent from the previous year. As a result, the annual inflow of immigrants is now 175,000, having steadily decreased from a peak of 653,000 in 2005, before the bursting of the housing bubble dried up construction and other low-wage jobs.

I called USCIS and checked about it. The officer said that she shoul dnot have applied online and made the payment. She should have sent paper application only. And that there was no need to pay any fee. He said that the amount once paid to USCIS can not be refunded back. Ridiculous.

I understand that when we re-enter the country using AP we will be given I-94 with the validity period just like that of AP.
So when we renew AP will they even renew the I-94?
